General terms and conditions of sale

Thank you to read carefully these conditions of sale before any order. They establish a contract relating to the articles and services on sale on the site of the store of the Airborne Museum. Clicking on the button "order" means that you accept the terms of this contract. The present contract is a contract of remote sale whose goal is to define the rights and obligations of the two parts within the framework of the sale of goods and services proposed to the customer. This contract includes the purchase of goods and services. It is concluded between the Airborne Museum and its customer.

The site of the store of the Airborne Museum is a service of the Airborne Museum 14, street Eisenhower 50480 Sainte-Mère-Eglise (France) whose goal is to propose its products on Internet.

Article 1 - Prices

The prices of our products are indicated in euros all taxes included (VAT + other taxes and in particular tax on the videograms, eco-participation...) except participation in the expenses of treatment and forwarding.

In the event of order towards a country other than metropolitan France you are the importer of the products concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated without taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not concern the spring of the Airborne Museum. They will be at your charge and are your responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities.

The Airborne Museum reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of your validation of order.

The products remain the property of the Airborne Museum until the complete payment of the price. We remind you that at the moment when you take physical possession of the ordered products, the risks of loss or damage of the products are transferred.

The Airborne Museum does not have vocation to sell to professionals, the products and services sold by the Airborne Museum are reserved for the private individuals.

Article 3 - Validation of your order

You declare that you have read and accepted these Terms and Conditions of Sale before placing your order. The validation of your order is therefore acceptance of these Terms and Conditions of Sale.

Article 4 - Availability

The Airborne Museum is a retailer and does not have vocation to sell in important quantities the proposed products. Consequently, the Airborne Museum reserves the right to refuse the orders of the same product in important quantity and this as of 3 identical Articles.

Our offers of products are valid as long as they are visible on the site, within the limit of stocks available except promotional operations mentioned as such on the sites. In the event of unavailability of product after placing your order, we will inform you by mail. Your order will be automatically cancelled.

Article 5 - Delivery

The products are delivered to the address of delivery that you indicated during the process of order within the maximum time of 20 days.

In the event of delivery by a conveyor requiring an appointment with the customer, this last will contact you as soon as possible to agree with you on an appointment of delivery, 30 days at the latest as from the date of your validation of order. The Airborne Museum cannot be responsible for delay of delivery due exclusively to an unavailability of the customer after several proposals of appointment by the conveyor.

In the event of delay of forwarding, an email will be addressed to you to inform you of a possible consequence on the delivery period which was indicated to you. In case of delay of delivery, we shall propose you by e-mail a new delivery period.

In any case, in accordance with the legal provisions, in case of delay of delivery, you benefit from the possibility of solving the contract in the conditions and modalities defined in the Article L 216-2 of the Code of the consumption. In this case, if you received the product, after your cancellation, we will proceed to the refunding of the product and to the expenses "to go" under the conditions of the Article L 216-3 of the Code of the consumption.

We remind you that at the time when you (or a third designated by you) take possession physically of the ordered products, the risks of loss or damage of the products go are transferred.

You must notify to the conveyor and the Airborne Museum any reserves on the delivered product (for example: damaged parcel, already opened...).

Article 6 - Payment

We remind you that the fact of validating your order implies the obligation to pay the price indicated.
The customer pays by credit card. The process of payment is protected by the SSL protocol. The customer certifies to the Airborne Museum that he or she has all the authorizations relating to the use of the method of payment chosen after having validated the form.

Article 7 - Security

Our site is subject to a security system.

We have adopted the SSL encryption process, but we have also strengthened all the scrambling and encryption processes to protect all the sensitive data related to the means of payment as effectively as possible.

Article 8 - Right of withdrawal

In accordance with the law of January 6, 1972 relating to the remote sale, the customer has a 7 days deadline of retractation as from the date of reception (for the purchase of goods), and of the date of acceptance of the contract (for the purchase of services). The use of this right of retractation obliges the Airborne Museum to refund the paid sum within 30 days.

The customer assumes the expenses caused by the return of the articles in their packing of origin.

The buyer does not have this right of withdrawal in the case of perishable products, foodstuffs, audio or video recordings, computer software whose packaging has been opened by the consumer, periodicals or magazines and services whose execution has begun before the end of the period of 7 days.

No shipment of cash on delivery will be accepted, whatever the reason.

Article 9 - Guarantees

The Airborne Museum guarantees the quality of the products presented on its site. The articles are guaranteed against any defect during the period defined by the manufacturer. This constitutes a contractual guarantee.
Any defect resulting from a bad use or an inappropriate use is excluded from this guarantee.

This guarantee contract does not cover:
- An article not functioning because of a bad electric connection; A bad application of the instructions appearing in the manual of use; The use of an article in an inappropriate way by negligence or error of the customer.
- The replacement of worn out or torn parts because of an abnormal use of the product.
- Any damage resulting from natural or accidental phenomena (water, fire etc.).

In the case of a complaint within the framework of the guarantee, the Airborne Museum has the duty to replace the article in question free of charge or to make it repair.

The products must be turned over to us or brought back in store in the state in which you received them with the whole of the elements (accessories, note...) in a packing allowing a transport under good conditions. Transportation costs are at the customer's expense.

Article 10 - Intellectual Property

All the texts, comments, works, illustrations works and images reproduced or represented on the site of the Airborne Museum are strictly reserved under the royalty like to the title of the intellectual property and for the whole world. As such and in accordance with the provisions of the code of the intellectual property, only the use for a private use under reserve of provisions different even more restrictive from the code of the intellectual property is authorized. Any reproduction or representation total or partial of the site of the Airborne Museum is strictly prohibited.

The corporate names, marks and distinctive signs reproduced on the site of the Airborne Museum are protected under the law of the marks. The reproduction or representation of all or part of one of the aforementioned signs is strictly prohibited and must be subject to prior written authorization from the owner of the brand.

Article 11 - Liability

The offered products are in conformity with the French legislation in force. The responsibility for the Airborne Museum could not be committed in the event of nonrespect of the legislation of the country where the product is delivered (for example in the event of prohibition of a title or a product). It is up to you to check with the local authorities the possibilities of importation or use of the products or services that you envisage to order.

The photos are communicated to title illustrative. We invite you to refer to the description of each product to know the precise characteristics. The Airborne Museum is responsible only for the contents of the pages which it publishes.

Article 12 - Applicable law - Disputes - Handling of claims

Applicable law: This contract is subject to French law. The language of this contract is French. In the event of litigation the French courts will be only qualified.

Article 13 - Personal data

The personal information and data concerning you are necessary for the management of your order and our commercial relations. They can be transmitted to the companies which contribute to these relations such as those in charge of the execution of the services and orders for their management, execution, treatment and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations and to enable us to improve and personalize the services we offer you and the information we send you.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and oppose any personal data concerning you. It is enough for you to write to us on line to infos@airborne-musuem.org or by mail to Airborne Museum, 14, rue Eisenhower - 50480 SAinte-Mère-Eglise, by indicating us your name, first name, e-mail address. In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of an identity card bearing your signature and specify the address to which the answer must reach you. A response will be sent to you within 2 months of receipt of the request.

Existence of a list of opposition to telephone canvassing: If your telephone number is collected when creating your account or placing your order, we inform you that your telephone number will only be used for the proper execution of your orders. Without prejudice to the above, in accordance with the legal provisions, you are informed that you can, if you wish, register on the list of opposition to telephone solicitation. You can register free of charge on this list, which is mandatory for all professionals except those with whom you have already concluded a contract.
