GENERAL TERMS AND CONDITIONS OF SALE
Please read these conditions of sale carefully before ordering. They establish a contract concerning the articles and services on sale on the Airborne Museum shop site. Clicking on the ‘order’ button means that you accept the terms of this contract. This contract is a distance selling contract, the purpose of which is to define the rights and obligations of both parties in the context of the sale of goods and services offered to the customer. This contract includes the purchase of goods and services. It is concluded between the Airborne Museum and its customer.
The site of the Airborne Museum shop is a service of the Airborne Museum 14, rue Eisenhower 50480 Sainte-Mère-Eglise (France) whose aim is to offer its products on the internet.
ARTICle I - PRIce
The prices of our products are indicated in euros, inclusive of all taxes (VAT + other taxes, in particular tax on videograms, eco-tax, etc.) and exclusive of shipping and handling costs.
If you order from a country other than mainland France, you are the importer of the product(s) concerned. For all products dispatched outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the Airborne Museum. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities/organisations in your country. We advise you to obtain information on these aspects from your local authorities.
The Airborne Museum reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of your order validation.
The products remain the property of the Airborne Museum until full payment of the price. We remind you that at the moment when you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.
The Airborne Museum does not sell to professionals; the products and services sold by the Airborne Museum are reserved for private individuals.

ARTICLE III - VALIDATING YOUR ORDER
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these General Terms and Conditions of Sale.
ARTICLE IV - availability
The Airborne Museum is a retailer and is not intended to sell the products offered in large quantities. Consequently, the Airborne Museum reserves the right to refuse orders for the same product in large quantities from 3 identical items.
Our product offers are valid as long as they are visible on the site, within the limits of available stocks, except for promotional operations mentioned as such on the sites. If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled.
ARTICLE V - delivery
Delivery
Products are delivered to the delivery address you indicated during the order process within a maximum of 20 days.
In the event of delivery by a carrier requiring an appointment to be made with the customer, the latter will contact you as soon as possible to arrange a delivery appointment with you, 30 days at the latest from the date of your order validation. The Airborne Museum cannot be held responsible for any delay in delivery due exclusively to the customer's unavailability after several proposed appointments by the carrier.
In the event of a delay in shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you. In the event of late delivery, we will propose a new delivery date by e-mail.
In any event, in accordance with legal provisions, in the event of late delivery, you may cancel the contract in accordance with the terms and conditions set out in Article L 216-2 of the French Consumer Code. In this case, if you have received the product after your cancellation, we will reimburse you for the product and the ‘outward’ costs in accordance with Article L 216-3 of the French Consumer Code.
We remind you that when you (or a third party designated by you) take physical possession of the products ordered, the risks of loss or damage to the products will pass to you.
You must notify the carrier and Airborne Museum of any reservations about the product delivered (for example: damaged package, already opened, etc.).
ARTICLE VI - payment
We would remind you that confirming your order implies your obligation to pay the price indicated.
The customer pays by credit card. The payment process is secured by SSL protocol. The customer certifies to the Airborne Museum that he or she has all the authorisations required to use the chosen method of payment after validating the form.
ARTICLE VII - security
Our site is protected by a security system.
We have adopted the SSL encryption process, but we have also strengthened all the scrambling and encryption processes to protect all sensitive payment data as effectively as possible.
ARTICLE VIII - DROIT DE RETRACTATION
In accordance with the law of 6 January 1972 on distance selling, the customer has a withdrawal period of 7 days from the date of receipt (for the purchase of goods), or from the date of acceptance of the contract (for the purchase of services). Use of this right of withdrawal obliges the Airborne Museum to reimburse the sum paid within 30 days.
The customer bears the costs of returning the items in their original packaging.
The purchaser does not have this right of withdrawal in the case of perishable products, foodstuffs, audio or video recordings, computer software whose packaging has been opened by the consumer, periodicals or magazines and services whose performance has begun before the end of the 7-day period.
Cash on delivery will not be accepted for any reason whatsoever.
ARTICLE IX - guarantees
The Airborne Museum guarantees the quality of the products presented on its site. The articles are guaranteed against any defect during the period defined by the manufacturer. This constitutes a contractual guarantee.
Any defect resulting from misuse or inappropriate use is excluded from this guarantee.
This guarantee contract does not cover:
- An item that does not work due to incorrect electrical connection; Incorrect application of the instructions in the user manual; Inappropriate use of an item due to negligence or error on the part of the customer.
- Replacement of worn or torn parts due to abnormal use of the product.
- Any damage resulting from natural or accidental phenomena (water, fire, etc.).
In the event of a claim under the guarantee, the Airborne Museum has a duty to replace the item in question free of charge or to have it repaired.
Products must be returned to us or to the shop in the condition in which you received them, with all components (accessories, instructions, etc.) in packaging that allows them to be transported in good condition. Transport costs are at the customer's expense.
ARTICLE X - intellectual properties
All texts, comments, works, illustrations, works and images reproduced or represented on the Airborne Museum site are strictly reserved under copyright law and intellectual property law for the entire world. As such, and in accordance with the provisions of the intellectual property code, only private use is authorised, subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction or representation of the Airborne Museum site is strictly prohibited.
The corporate names, trademarks and distinctive signs reproduced on the Airborne Museum site are protected under trademark law. The reproduction or representation of all or part of one of the aforementioned signs is strictly prohibited and must be subject to prior written authorisation from the owner of the trademark.
ARTICLE XI - responsibility
The products offered comply with current French legislation. The responsibility for Airborne Museum could not be committed in the event of non-observance of the legislation of the country where the product is delivered (for example in the event of prohibition of a title or a product). It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you are considering ordering.
The photos are provided for illustrative purposes only. Please refer to the description of each product for its precise characteristics. The Airborne Museum is only responsible for the content of the pages it publishes.
ARTICLE XII - Applicable law, disputes and claims
Applicable law: This contract is governed by French law. The language of this contract is French. In the event of a dispute, the French courts shall have exclusive jurisdiction.

ARTICLE XIII - personal data
The personal information and data concerning you are necessary for the management of your order and our commercial relations. It may be passed on to companies that contribute to these relations, such as those responsible for the execution of services and orders, for their management, execution, processing and payment. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you.
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and object to any personal data concerning you. All you have to do is write to us online at infos@airborne-musuem.org or by post to Airborne Museum, 14, rue Eisenhower - 50480 SAinte-Mère-Eglise, giving us your surname, first name, e-mail address. In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of an identity document bearing your signature and specify the address to which the reply should be sent. A reply will be sent to you within 2 months of receipt of the request.
Existence of an opposition list against telephone canvassing: If your telephone number is collected when creating your account or placing your order, we inform you that your telephone details will only be used for the proper execution of your orders. Without prejudice to the foregoing, in accordance with legal provisions, you are informed that you may, if you wish, register on the list of opposition to telephone canvassing. You can register free of charge on this list, which applies to all professionals except those with whom you have already concluded a contract.
